The ongoing battle for creative rights

Historically, the entertainment industry has been wary of AI’s encroachment on creative work. During the 2024 SAG-AFTRA negotiations, the union representing approximately 160,000 performers faced challenges in reaching an agreement on AI regulations. The union’s demands included obtaining consent from actors for the creation and use of their digital replicas, as well as ensuring fair compensation for performances rendered by AI. After a protracted 118-day strike, SAG-AFTRA successfully secured provisions that address consent and compensation in the context of AI usage in film and television.

In response to these concerns, California Governor Gavin Newsom enacted two bills aimed at protecting actors from unauthorized AI replicas. These laws mandate that labor contracts specify the use of AI-generated replicas and prohibit the commercial exploitation of digital representations of deceased performers without consent from their estates. As the number of artists endorsing the open letter continues to rise, the entertainment industry emphasizes its economic significance, supporting over 2.3 million jobs and generating more than $229 billion in wages annually.
